Child Support

In the state of New York, the amount of child support that is to be paid is set by a very specific set of guidelines and calculated through a formula. When determining the "basic child support obligation," the court must calculate the combined parental income and multiply it by the appropriate child support percentage. For child support purposes, "income" is defined as the "gross income as was or should have been reported on the most recent federal income tax return."

Based upon the combined parental income, the child support percentages are as follows:

  • 17% for one child
  • 25% for two children
  • 29% for three children
  • 31% for four children
  • no less than 35% for five or more children
